Terms of Service
CNY Game Devs (cnygamedevs.com)
Last updated: October 11, 2026
1. Agreement to Terms
By creating an account on or using CNY Game Devs ("the Site," "we," "us," "our"), you agree to these Terms of Service ("Terms"), our Privacy Policy, and our Content Policy. If you do not agree, do not use the Site.
These Terms are a legally binding agreement between you and Cyborg Interactive, LLC, a New York limited liability company that operates the Site on behalf of the CNY Game Devs community.
2. What the Site Is
CNY Game Devs is a community website for people in Central New York who make games or want to learn how. Registered members can publish a profile, list projects, write blog posts and devlogs, share portfolio work, and submit events to a community calendar. Visitors can read public content without an account.
The Site is run by volunteers. It is not a school, employer, publisher, or agent for any member.
3. Eligibility and Age
You must be at least 13 years old to create an account. If you live in the European Union, you must be at least 16. By registering you confirm that you meet this requirement.
Some in-person events may have their own age rules set by the venue. Those are separate from these Terms.
4. Accounts
4.1 Registration and Review
When you register, your account starts in a pending state. An organizer reviews new accounts before the profile and any content become visible to the public. We may approve or decline an account at our discretion, including because we don't recognize you from the community. Declined accounts can still log in but cannot publish.
4.2 Accuracy
Provide accurate information and keep it current. Use your real name or the name you are known by in the community. Impersonating another person, studio, or organization is prohibited.
4.3 Security
You are responsible for your password and for everything done with your account. Tell us at [email protected] right away if you believe your account has been accessed without permission.
4.4 One Account Per Person
One account per person. Studio or team accounts are allowed only if they are clearly labeled as such in the display name.
4.5 Closing Your Account
You can ask us to delete your account at any time by emailing [email protected] (a self-service delete button is planned). Deletion removes your profile and the content you posted, as described in the Privacy Policy.
5. Your Content
5.1 You Own It
You keep all rights to the text, images, audio, code, resumes, and other material you post ("Your Content"). We do not claim ownership of it.
5.2 License to Us
So that the Site can work, you grant Cyborg Interactive, LLC a non-exclusive, worldwide, royalty-free license to host, store, display, reproduce, and format Your Content on the Site and in connection with promoting the community (for example, a screenshot of the members page at a meetup). This license lasts while the content is on the Site and ends when you delete it, except that copies may persist in backups for up to 30 days.
5.3 You Are Responsible for It
You confirm that you have the rights to post Your Content and that it does not infringe anyone's copyright, trademark, privacy, or other rights. If you post work made with a team, make sure your teammates are okay with it. If you post game assets, music, or code you licensed from someone else, make sure the license allows it.
5.4 Visibility Settings
You choose whether each item is public, members-only, or private. "Members-only" means visible to approved, logged-in members. We will honor these settings, but organizers and administrators can always see all content for moderation purposes.
5.5 Resumes and Contact Information
If you upload a resume or add contact details, you are choosing to share them with whoever can see your profile. Think about what you include. We recommend leaving your home address off.
6. Acceptable Use
The full rules are in our Content Policy, which is part of these Terms. In short, do not:
- Harass, threaten, or demean other people
- Post content that is illegal, hateful, sexually explicit, or that depicts minors sexually
- Post other people's work as your own or without permission
- Post spam, unsolicited advertising, or affiliate links
- Scrape, crawl, or bulk-download member information
- Attempt to break into the Site, other members' accounts, or our infrastructure
- Use the member directory to recruit for schemes, send mass unsolicited messages, or build mailing lists
We may remove content, suspend accounts, or ban members for violations, with or without notice.
7. Events
The calendar lists events submitted by members and approved by organizers. Unless an event is clearly marked as hosted by CNY Game Devs, it is run by the submitting member, not by us. We do not guarantee that any event will take place as listed. Attend events at your own discretion and follow the venue's rules.
8. Copyright and DMCA
We respond to copyright complaints under the Digital Millennium Copyright Act. Our full process, including how to send a takedown notice and a counter-notice, is in our Copyright & DMCA page. Members whose content is the subject of repeated valid complaints will have their accounts terminated.
9. Our Content
The CNY Game Devs name and logo, the Site's design, and the Site's original code belong to Cyborg Interactive, LLC. You may not use the name or logo to imply endorsement without written permission. Linking to the Site is always fine.
10. Third-Party Links and Embeds
Members post links to outside sites (itch.io, GitHub, YouTube, Discord, and so on) and we embed some third-party content such as YouTube videos. We don't control those services and aren't responsible for them. Their own terms and privacy policies apply when you use them.
11. Disclaimer of Warranties
THE SITE IS PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. We do not promise that the Site will be uninterrupted, error-free, or secure, that content posted by members is accurate, or that any member is who they say they are. This is a volunteer community project.
12. Limitation of Liability
TO THE FULLEST EXTENT PERMITTED BY LAW, CYBORG INTERACTIVE, LLC, ITS MEMBERS, AND THE CNY GAME DEVS ORGANIZERS ARE NOT LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR LOSS OF DATA, PROFITS, OR GOODWILL, ARISING FROM YOUR USE OF THE SITE OR FROM CONTENT POSTED BY OTHER MEMBERS. Our total liability for any claim relating to the Site will not exceed USD $100.
Some jurisdictions do not allow these limitations, so they may not fully apply to you.
13. Indemnification
If someone makes a claim against us because of Your Content or your use of the Site, you agree to defend and indemnify Cyborg Interactive, LLC and the organizers against that claim, including reasonable legal fees.
14. Termination
You can stop using the Site at any time. We can suspend or terminate your access at any time for any reason, including violation of these Terms or the Content Policy. Sections 5.2 (for content that remains), 9, 11, 12, 13, and 16 survive termination.
15. Changes to These Terms
We may update these Terms. We will change the "Last updated" date and, for material changes, notify registered members by email or a notice on the Site at least 14 days before they take effect. Continued use after that date means you accept the new Terms.
16. Governing Law
These Terms are governed by the laws of the State of New York. Any dispute will be brought in the state or federal courts located in Oneida County, New York, and you consent to their jurisdiction.
